License Agreement for Kubek Server Manager

1. GENERAL PROVISIONS
1.1. This License Agreement (hereinafter referred to as the Agreement) sets forth the terms of use of the Kubek software (hereinafter referred to as the Software) and applies to all relations between the user (hereinafter referred to as the User) and the Software right holder.

1.2. The User's use of this Software is permitted only upon the User's full and unconditional acceptance of the terms of this Agreement and automatically means that the User agrees to all clauses of this Agreement.

2. TERMS OF USE
2.1. The Software right holder grants the User the right to use the Software in accordance with its functional purpose.

2.2. The User understands and agrees that the Software is an independent product of the right holder and is in no way affiliated with Mojang AB, Microsoft or Minecraft. All mentioned trademarks are the property of their respective owners.

3. LIABILITY
3.1. In the event of a violation of the terms of this Agreement by the User, the Software right holder reserves the right to apply measures provided for by applicable law.

3.2. The User bears full responsibility for the safety of their servers, files and confidential data, as well as for all actions performed using this Software.

4. AMENDMENT OF THE AGREEMENT
4.1. The Software right holder reserves the right to change the terms of this Agreement at any time and will promptly notify Users of such changes.

4.2. Continued use of the Software after changes to this Agreement take effect constitutes acceptance of and consent to such changes by the User.

5. DATA COLLECTION
5.1. By using this Software, the User confirms their consent to the automatic transmission of statistical data to a server controlled and managed by the Software right holder. Transmission occurs upon Software launch and subsequently approximately once every 5 minutes during program operation. The following data is transmitted:
— Unique device identifier of the User
— Central processor information (name, frequency, number of cores)
— RAM amount information
— Paths to installed Java versions
— Operating system information (name, version, build, architecture)
— Version of the Kubek Software in use
— Number of servers in use within the Software
— Number of users added
— Software uptime
— Information on whether individual features are enabled (Telegram bot, FTP server)
All transmitted data is current at the time of automatic statistics transmission.
5.2. This data is required to optimize the program for user needs and to deprecate or improve individual features.
5.3. The Software right holder reserves the right to store, process, examine and destroy the collected statistical data on servers under its control.
5.4. The collection and transmission of statistical data can be disabled in the Software settings or by using the KUBEK_TELEMETRY=off environment variable.
